MASTERCARD® GIFT CARD TERMS AND CONDITIONS [Back to Top]

(For cards purchased at Fifth Third Financial Centers prior to August 2010)

These terms and conditions (Terms and Conditions) govern the use of the MasterCard Gift Card (Gift Card).  Please read them carefully and keep them for your records or give them to the person to whom you give your Gift Card.  By accepting or using your Gift Card, you agree to be bound by these Terms and Conditions.  The terms "you" and "your" refer to the person who receives or who is using the Gift Card. The terms "we," "our" and "us" refer to Fifth Third Bank and our successors or assigns. Our Business Days are Monday through Friday, except federal holidays.

1.             The Gift Card.  Your Gift Card is a prepaid card that you can use at retail establishments and restaurants that accept MasterCard debit cards, including mail order and online merchants. You or the person to whom you give the Gift Card as a gift should sign the back of the Gift Card immediately before the Gift Card is used.  Your Gift Card cannot be used at ATMs, point of sale terminals that require the use of a personal identification number or automated fuel pumps.  Your Gift Card also cannot be used for any cash advances, for Internet lottery, betting, or gambling transactions or for any illegal transactions.

2.             Activating Your Gift Card.  Your Gift Card has no value until it is activated and signed on the back of the Card where indicated.  We recommend that you write down the Card number and the customer service number on a separate piece of paper in case your Gift Card is lost or stolen.

3.             Registration. If you are the person who will be using the Gift Card, we strongly encourage you to register it at www.53giftcard.com. Registration is required if you intend to use the Gift Card to make purchases over the Internet. For your protection, we may request identification information from you during the registration process.

4.             No FDIC Insurance.  Your Gift Card funds are not a deposit and are not insured by the Federal Deposit Insurance Corporation. 

5.             Not a Credit Card.  Your Gift Card is not a credit or charge card, and using it will not enhance your credit rating.  No interest, dividends or other earnings or returns will be paid on your Gift Card.

6.             Your Balance.  We refer to the value of the funds on your Gift Card and that are available for spending as your Balance.  As you use your Gift Card, your Balance will be reduced by the full amount of each purchase, including taxes and other charges, if any.  You may not use your Gift Card for any amount that exceeds your Balance or after the "valid thru" date printed on its face, whichever occurs first.

7.             Asking about Your Balance.  It is important to keep track of the amount of your Balance.  You may obtain information about your Balance or your transaction history by visiting the Internet at www.53giftcard.com or by calling us toll-free at the Customer Service number shown on the Gift Card (1-866-466-0059).

8.             Transaction Limits

  1. Non-transferable. Once Signed. Once the Gift Card is signed, it is non-transferable. Please do not give your Gift Card to anyone else to use once you have signed the back of it. Please do not sign the Gift Card if you intend to give it as a gift to another person. The person who receives it as a gift should be the person who signs it.
  2. Not Reloadable. Your Gift Card is not reloadable and cannot be reused after all the original value has been used.
  3. Point of Sale Use and Hold Periods. When you use your Gift Card to obtain goods or services, the merchant may attempt to obtain preauthorization for the transaction. There may be a hold of up to 10 days placed on your Gift Card for the amount of the preauthorization request, which means those funds may not be used for any other purpose during the hold period. If the preauthorization request varies from the amount of the actual transaction, payment of the transaction may not remove the hold, which may remain on your Gift Card.
  4. Transactions in Excess of Balance. If the Balance on your Gift Card is insufficient to complete a transaction, the transaction may be denied. If you know this, we suggest you tell the merchant that you want to do a Split Tender Transaction. In other words, use what's left on your Gift Card and pay the balance in cash, with a check or by some other method. The merchant may not be willing to do a Split Tender Transaction. If you are able to complete a transaction even though the Balance on your Gift Card is not enough to cover the amount of the transaction, creating what we call a Shortage, you agree to pay us immediately upon our request the amount of the Shortage plus accrued interest on the unpaid amount at the highest rate permitted by applicable law, plus our reasonable attorney fees, collection expenses and court costs and expenses.
  5. Special Situations. Restaurants and hotels may authorize your Gift Card for 10% to 20% more than the purchase amount in order to cover any anticipated gratuity or incidental hotel charges. Because these authorizations may be greater than the Balance on your Gift Card, the transaction may be declined.

9.             Conversion to U.S. Dollars. Transactions made in currencies other than U.S. Dollars will be converted to U.S. Dollars under regulations established by MasterCard and may include a margin and fees charged directly by MasterCard.  Conversion to U.S. Dollars may occur on a date other than the date of the transaction; therefore, the conversion rate may be different from the rate in effect at the time of the transaction.  You agree to pay the converted amount.  It will be deducted from your Balance.  For these transactions, the rate of exchange between the transaction currency and the billable currency is either a wholesale market rate or the government-mandated rate in effect one day prior to the conversion date. 

10.           Lost or Stolen Gift Cards; Unauthorized Transactions.  YOUR GIFT CARD IS LIKE CASH.  PLEASE SAFEGUARD YOUR GIFT CARD AND TELL US IMMEDIATELY IF THE GIFT CARD IS LOST OR STOLEN.  If your Gift Card is lost, stolen, or used improperly, contact us immediately, 24 hours a day, 7 days a week, at the Customer Service number shown on the Gift Card (1-866-466-0059). You will be asked to provide us with the Gift Card number and other identifying information.  If you have not registered your Gift Card, we may not be able to provide a refund. You will have no liability for unauthorized use of your Gift Card for transactions if (a) you have exercised reasonable care in safeguarding the Gift Card from risk of loss or theft and (b) you have not reported two or more incidents of unauthorized use to us in the immediately preceding twelve month period. If you do not meet these conditions your liability is limited to a maximum of $50.00. If we can confirm that you are the owner of the Gift Card, we will cancel the Gift Card and either issue you a new Gift Card or provide a refund to you by check.

11.           Error Resolution Procedures.  If you have a question or a problem about a transaction posted to your Gift Card you must notify us immediately, and no later than 60 days from the date of the transaction.  You must tell us the following:

  • Your name and the name of the purchaser of the Gift Card.
  • The number of the Gift Card.
  • The error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  • The date and the dollar amount of the suspected error. 

If you tell us orally, we require that you confirm the information you provided in writing within 10 business days.  We will determine whether an error has occurred and notify you of the results of our investigation within 60 days after we hear from you and will refund to you the amount of any error promptly. 

12.           Contact Information.  If you need to write us to report a suspected error, to claim any unused Balance or for any other reason, write to Fifth Third Bank, P.O. Box 7235 , Sioux Falls, SD 57117-7235.  If you need to report a lost or stolen Gift Card or have other questions regarding your Gift Card, you may call Customer Service at 1-866-466-0059.

13.           Your Gift Card's Valid Thru Date.  Your Gift Card has a "valid thru" date indicated on its face.  That is the date after which you may not use your Gift Card.  However, exceeding the "valid thru" date does not mean that your Balance has expired.  If the "valid thru" date has passed and you still have a Balance on your Gift Card, we will refund the Balance to you no later than 30 days after you send us in writing the name of the purchaser of the Gift Card, your name, your mailing address and the Gift Card number.  We may issue you a new Gift Card, or, if you wish, we will mail a check to you in the amount of the Balance.  There is a fee for sending you a new Gift Card and a fee for sending you a check.  They are set out below in the Fee Schedule. 

14.           No Warranty of Availability or Uninterrupted Use.  From time to time the Gift Card service, including the website where you may obtain information about your Gift Card, may be inoperative, and when this happens, you may be unable to use your Gift Card or obtain information about your Gift Card.  Please notify us if you have any problems using your Gift Card.  You agree that we will not be responsible for the failure of any merchant to honor your Gift Card, any interruption of service, or any damage to your computer or other equipment that may be caused by computer "viruses" when you use the website.  You agree to act responsibly with regard to the website and its use.

15.           No Warranty Regarding Goods and Services.  We will not be responsible for the quality, safety or any other aspect of any goods or services purchased with your Gift Card.  Any disputes should be addressed to the merchant where you bought the goods and services.

16.           Your Unused Balance and Service Fees.  We encourage you to use your Gift Card soon! A monthly Service Fee may be deducted from your card balance if card is not used for 12 consecutive months or more. The Balance on your Gift Card can be completely consumed by Service Fees if you do not use your Card or request a check for the remaining Balance.  The amount of the service fee may be adjusted if required by applicable law.  Please refer to the Fee Schedule for the amount of the Service Fee

17.           Changes to This Agreement.  These Terms and Conditions constitute the entire agreement between the parties.  We may delay or waive any of our rights at any time without waiving any of our rights at any future time.  Except as otherwise required by applicable law, we may change these Terms and Conditions and any Gift Card services, at any time.  You agree that we can give you notice of any changes by posting a notice at our internet address set forth above.  Such changes will be effective immediately.

18.           Disclosure of Information to Third Parties.  We will only disclose information to third parties about your Gift Card or the transactions that you make:

  • Where it is necessary to complete the transaction;
  • In order to verify the existence and condition of your Gift Card;
  • In order to comply with government agency or court orders or as otherwise required by law or in connection with examinations by banking authorities;
  • If we conclude that disclosure is necessary to protect your or our interests; or
  • If you give us permission.

 19.          DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY OTHERWISE PROVIDED IN THIS AGREEMENT, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND TO YOU, WHETHER EXPRESS OR IMPLIED, REGARDING THE GIFT CARD, CUSTOMER SERVICE FUNCTIONS, OR ANY OTHER SUBJECT MATTER OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

20.           Applicable Law.  These Terms and Conditions and the use of the Gift Card are governed by, and interpreted under, the laws of the State of Ohio, without reference to principles of conflict of laws. 

21.            Fee Schedule.

Service Fee:                                                           $2.50 per month, for cards with no activity for 12 months or more

Gift Card Re-Issuance Replacement Card Fee:       $10.00

10.           Consumers' Liability for Unauthorized Purchases

Tell us AT ONCE if you believe your card or password has been lost or stolen or if you believe that a purchase has been made without your permission. Telephoning is the best way of keeping your possible losses down. If you tell us within two (2) business days, you can lose no more than $50.00 if someone used your Card without permission. If you do NOT tell us within two (2) business days after you learn of the loss of theft of your Card, and we can prove that we could have stopped someone from using your card without your permission if you would have told us, you could lose as much as $500.00. Also, if your account shows purchases that you did not make or which were not authorized by you, tell us at once. If you do not tell us within sixty (60) days after the balance information was made available to you, you may not get back any money you lost after the sixty (60) days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or hospital stay) kept you from telling us, we will extend the time period for a reasonable time. If you believe your card or password has been lost or stolen or that someone has used your card without permission, contact us at the address or telephone number listed under the "Contact Information" section of this document. Our business days are Monday through Friday. Holidays are not included.

10.           Lost or Stolen Gift Cards; Unauthorized Transactions.  YOUR GIFT CARD IS LIKE CASH.  PLEASE SAFEGUARD YOUR GIFT CARD AND TELL US IMMEDIATELY IF THE GIFT CARD IS LOST OR STOLEN.  If your Gift Card is lost, stolen, or used improperly, contact us immediately, 24 hours a day, 7 days a week, at the Customer Service number shown on the Gift Card (1-866-466-0059). You will be asked to provide us with the Gift Card number and other identifying information.  If you have not registered your Gift Card, we may not be able to provide a refund. You will have no liability for unauthorized use of your Gift Card for transactions if (a) you have exercised reasonable care in safeguarding the Gift Card from risk of loss or theft and (b) you have not reported two or more incidents of unauthorized use to us in the immediately preceding twelve month period. If you do not meet these conditions your liability is limited to a maximum of $50.00. If we can confirm that you are the owner of the Gift Card, we will cancel the Gift Card and either issue you a new Gift Card or provide a refund to you by check.

11.           Error Resolution Procedures.  If you have a question or a problem about a transaction posted to your Gift Card you must notify us immediately, and no later than 60 days from the date of the transaction.  You must tell us the following:

  • Your name and the name of the purchaser of the Gift Card.
  • The number of the Gift Card.
  • The error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  • The date and the dollar amount of the suspected error.

If you tell us orally, we require that you confirm the information you provided in writing within 10 business days.  We will determine whether an error has occurred and notify you of the results of our investigation within 60 days after we hear from you and will refund to you the amount of any error promptly. 

12.           Contact Information.  If you need to write us to report a suspected error, to claim any unused Balance or for any other reason, write to Fifth Third Bank, P.O. Box 7235 , Sioux Falls, SD 57117-7235.  If you need to report a lost or stolen Gift Card or have other questions regarding your Gift Card, you may call Customer Service at 1-866-466-0059.

13.           Your Gift Card's Valid Thru Date.  Your Gift Card has a "valid thru" date indicated on its face. That is the date after which you may not use your Gift Card.  However, exceeding the "valid thru" date does not mean that your Balance has expired.  If the "valid thru" date has passed and you still have a Balance on your Gift Card, we will refund the Balance to you no later than 30 days after you send us in writing the name of the purchaser of the Gift Card, your name, your mailing address and the Gift Card number.  We may issue you a new Gift Card, or, if you wish, we will mail a check to you in the amount of the Balance.  There is a fee for sending you a new Gift Card and a fee for sending you a check.  They are set out below in the Fee Schedule. 

14.           No Warranty of Availability or Uninterrupted Use.  From time to time the Gift Card service, including the website where you may obtain information about your Gift Card, may be inoperative, and when this happens, you may be unable to use your Gift Card or obtain information about your Gift Card.  Please notify us if you have any problems using your Gift Card.  You agree that we will not be responsible for the failure of any merchant to honor your Gift Card, any interruption of service, or any damage to your computer or other equipment that may be caused by computer "viruses" when you use the website.  You agree to act responsibly with regard to the website and its use.

15.           No Warranty Regarding Goods and Services.  We will not be responsible for the quality, safety or any other aspect of any goods or services purchased with your Gift Card.  Any disputes should be addressed to the merchant where you bought the goods and services.

16.           Your Unused Balance and Service Fees.  We encourage you to use your Gift Card soon! You may keep a remaining Balance on your Gift Card as long as you wish and may contact us at any time to redeem it but, i If a Balance remains on the Card for more than 12 months after the card has been activated, we may deduct from the Balance a Service Fee beginning in the 13th month after the month in which the Gift Card was activated. The Balance on your Gift Card can be completely consumed by Service Fees if you do not use your Card or request a check for the remaining Balance.  The amount of the service fee may be adjusted if required by applicable law.  Please refer to the Fee Schedule for the amount of the Service Fee. 

17.           Changes to This Agreement.  These Terms and Conditions constitute the entire agreement between the parties.  We may delay or waive any of our rights at any time without waiving any of our rights at any future time.  Except as otherwise required by applicable law, we may change these Terms and Conditions and any Gift Card services, at any time.  You agree that we can give you notice of any changes by posting a notice at our internet address set forth above.  Such changes will be effective immediately.

18.           Disclosure of Information to Third Parties.  We will only disclose information to third parties about your Gift Card or the transactions that you make:

  • Where it is necessary to complete the transaction;
  • In order to verify the existence and condition of your Gift Card;
  • In order to comply with government agency or court orders or as otherwise required by law or in connection with examinations by banking authorities;
  • If we conclude that disclosure is necessary to protect your or our interests; or
  • If you give us permission.

19.            DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY OTHERWISE PROVIDED IN THIS AGREEMENT, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND TO YOU, WHETHER EXPRESS OR IMPLIED, REGARDING THE GIFT CARD, CUSTOMER SERVICE FUNCTIONS, OR ANY OTHER SUBJECT MATTER OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

20.           Applicable Law.  These Terms and Conditions and the use of the Gift Card are governed by, and interpreted under, the laws of the State of Ohio, without reference to principles of conflict of laws. 

21.            Fee Schedule.

GIFT CARD TERMS AND CONDITIONS

(For cards purchased or received as part of the Fifth Third Bank Loyalty/Award/Promo Card Program after August 2010)

These terms and conditions (Terms and Conditions) govern the use of the Fifth Third Bank Loyalty/Award/Promo MasterCard Gift Card (Gift Card).  Please read them carefully and keep them for your records or give them to the person to whom you give your Gift Card.  By accepting or using your Gift Card, you agree to be bound by these Terms and Conditions.  The terms "you" and "your" refer to the person who receives or who is using the Gift Card. The terms "we," "our" and "us" refer to Fifth Third Bank and our successors or assigns. Our Business Days are Monday through Friday, except federal holidays.

1.             The Gift Card.  Your Gift Card is a prepaid card that you can use at retail establishments and restaurants that accept MasterCard debit cards, including mail order and online merchants. You or the person to whom you give the Gift Card as a gift should sign the back of the Gift Card immediately before the Gift Card is used.  Your Gift Card cannot be used at ATMs, point of sale terminals that require the use of a personal identification number or automated fuel pumps.  Your Gift Card also cannot be used for any cash advances, for Internet lottery, betting, or gambling transactions or for any illegal transactions.

2.             Activating Your Gift Card.  Your Gift Card has no value until it is activated and signed on the back of the Card where indicated.  We recommend that you write down the Card number and the customer service number on a separate piece of paper in case your Gift Card is lost or stolen.

3.             Registration. If you are the person who will be using the Gift Card, we strongly encourage you to register it at www.53giftcard.com. Registration is required if you intend to use the Gift Card to make purchases over the Internet. For your protection, we may request identification information from you during the registration process.

4.             No FDIC Insurance.  Your Gift Card funds are not a deposit and are not insured by the Federal Deposit Insurance Corporation. 

5.             Not a Credit Card.  Your Gift Card is not a credit or charge card, and using it will not enhance your credit rating.  No interest, dividends or other earnings or returns will be paid on your Gift Card.

6.             Your Balance.  We refer to the value of the funds on your Gift Card and that are available for spending as your Balance.  As you use your Gift Card, your Balance will be reduced by the full amount of each purchase, including taxes and other charges, if any.  You may not use your Gift Card for any amount that exceeds your Balance or after the "valid thru" date printed on its face, whichever occurs first.

7.             Asking about Your Balance.  It is important to keep track of the amount of your Balance.  You may obtain information about your Balance or your transaction history by visiting the Internet at www.53giftcard.com or by calling us toll-free at the Customer Service number shown on the Gift Card (1-866-466-0059).

8.             Transaction Limits. 

  1. Non-transferable Once Signed. Once the Gift Card is signed, it is non-transferable. Please do not give your Gift Card to anyone else to use once you have signed the back of it. Please do not sign the Gift Card if you intend to give it as a gift to another person. The person who receives it as a gift should be the person who signs it.
  2. Not Reloadable. Your Gift Card is not reloadable and cannot be reused after all the original value has been used.
  3. Point of Sale Use and Hold Periods. When you use your Gift Card to obtain goods or services, the merchant may attempt to obtain preauthorization for the transaction. There may be a hold of up to 10 days placed on your Gift Card for the amount of the preauthorization request, which means those funds may not be used for any other purpose during the hold period. If the preauthorization request varies from the amount of the actual transaction, payment of the transaction may not remove the hold, which may remain on your Gift Card.
  4. Transactions in Excess of Balance. If the Balance on your Gift Card is insufficient to complete a transaction, the transaction may be denied. If you know this, we suggest you tell the merchant that you want to do a Split Tender Transaction. In other words, use what's left on your Gift Card and pay the balance in cash, with a check or by some other method. The merchant may not be willing to do a Split Tender Transaction. If you are able to complete a transaction even though the Balance on your Gift Card is not enough to cover the amount of the transaction, creating what we call a Shortage, you agree to pay us immediately upon our request the amount of the Shortage plus accrued interest on the unpaid amount at the highest rate permitted by applicable law, plus our reasonable attorney fees, collection expenses and court costs and expenses.
  5. Special Situations. Restaurants and hotels may authorize your Gift Card for 10% to 20% more than the purchase amount in order to cover any anticipated gratuity or incidental hotel charges. Because these authorizations may be greater than the Balance on your Gift Card, the transaction may be declined.

9.             International Transaction Fee. Effective for all transactions outside of the United States, or in a foreign currency, we will assess a transaction fee equal to 3% of the U.S. Dollar amount of each such Foreign Transaction. This fee will be in addition to any other applicable transaction fees. If a transaction is made in a foreign currency, MasterCard International will convert the transaction into a U.S. dollar amount. MasterCard will act in accordance with their operating regulations or conversion procedures in effect at the time the transaction is processed. Currently, their regulations and procedures provide that the currency conversion rate they use is either (1) a wholesale market rate or (2) a government-mandated rate in effect one day prior to the processing date. The currency conversion rate calculated in this manner that is in effect on the processing date may differ from the rate in effect on the transaction date or the posting date.

10.           Consumers' Liability for Unauthorized Purchases

Tell us AT ONCE if you believe your card or password has been lost or stolen or if you believe that a purchase has been made without your permission. A Replacement Card Fee may apply, per the Fee Schedule below. Telephoning is the best way of keeping your possible losses down. If you tell us within two (2) business days, you can lose no more than $50.00 if someone used your Card without permission. If you do NOT tell us within two (2) business days after you learn of the loss of theft of your Card, and we can prove that we could have stopped someone from using your card without your permission if you would have told us, you could lose as much as $500.00. Also, if your account shows purchases that you did not make or which were not authorized by you, tell us at once. If you do not tell us within sixty (60) days after the balance information was made available to you, you may not get back any money you lost after the sixty (60) days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or hospital stay) kept you from telling us, we will extend the time period for a reasonable time. If you believe your card or password has been lost or stolen or that someone has used your card without permission, contact us at the address or telephone number listed under the "Contact Information" section of this document. Our business days are Monday through Friday. Holidays are not included.

When the Card expires, it will be cancelled and any unused balance will be handled according to applicable unclaimed property law.
